This page informs you of our policies regarding the collection, use and disclosure of Personal Data when you use our Services, including, but not limited to our subscription-based Services, and the choices you have associated with that data.
PodUP(formerly ShowPlatform) may process Personal Data as a processor under the direction of our customers. Our customers, as Data Controllers, are responsible for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to the collecting of their customers’ Personal Data using any subscription-based Services.
We may use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions of Service.
State laws like the CCPA and VCDPA also provide the right to request information about how PodUP collects, uses, and discloses your information. And they give you the right to access and correct your information, and to request that PodUP delete that information. The VCDPA also provides the right to opt out of certain forms of profiling and targeted advertising. Finally, the CCPA and VCDPA provide the right to not be discriminated against for exercising these privacy rights. More information regarding both the CCPA and the VCDPA can be found below.
We may update this Privacy Policy from time to time and we encourage you to review this Privacy Policy periodically. We will post any Privacy Policy changes on this page and, if the changes are material, we will attempt to provide a more prominent notice by sending you an email notification, or if you subscribe to our subscription services, through notification to your account with us, or when you visit one of our webpages.
Definitions
Services: Services include, but are not limited to all websites (including, but not limited to www.PodUP.com), apps, software, SAAS, and web services offered by PodUP, as well as any and all other service described herein or elsewhere by PodUP, or which references this Privacy Policy.
Personal Data: Personal Data means data about a living individual who can be identified from such data (or from those and other information either in our possession or likely to come into our possession).
Usage Data: Usage Data is data collected automatically either generated by the use of the Services or from the Services infrastructure itself (for example, the duration of a page visit).

Usage Data: We may also collect information on how the Services is accessed and used. This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Facebook Analytics, Advertising, Login App & Social Feature

In conjunction with our app, i.e., PodUp (formerly ShowPlatform), we may utilize Facebook technologies for customizing content, features, apps, and advertising, as well as for software integration, social media features, and the analysis of traffic and website usage."

Commercial Information
We collect payment and billing information when you register for paid products or Services. If you give us payment information, we use it solely as authorized by you in accordance with this Privacy Policy. We use secure third-party payment service providers to manage payment processing, which is collected through a secure payment process.
HOW WE USE OF DATA
Information We Process on Behalf of Customers When they Use the Subscription Service.
Our product, or the Subscription Service, allows our customers to create and share podcasts, shows, including marketing, sales and customer service content. When customers use our Services, they may collect Personal Data such as first and last name, email address, physical address, phone number, or other information about you. We call the information that our customers submit or collect via the product “Customer Data.”
We do not control the content of our customers’ webpages or the types of Personal Data that our customers may choose to collect or manage using the Subscription Service. We store our customers’ information on our service providers’ servers but process it as a processor under our customers’ instructions, but in so doing, we are prohibited from using the information except as necessary to provide and improve the Subscription Services and as required by law.
Our customers control and are responsible for correcting, deleting or updating the information they process using the Subscription Services and for complying with any regulations or laws that require providing notice, disclosure, and/or processing purposes.
Information We May Collect.
PodUP may use collected data for various purposes:
- To provide and maintain our Services
- To notify you about changes to our Services
- To allow you to participate in interactive features of our Services when you choose to do so
- To provide customer support
- To gather analysis or valuable information so that we can improve our Services
- To monitor the usage of our Services
- For auditing and analytic evaluation

- To detect, prevent and address technical issues

PodUP will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.
PodUP will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer periods.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there. With that said, at present we do not target or provide Services to individuals or businesses located outside the United States.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
PodUP will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
Why We May Disclose Your Information
The PodUP website, app, email list, and other Services are operated by PodUP may disclose your Personal Data in the good faith belief that such action is necessary to:
- To comply with a legal obligation
- To protect and defend the rights or property of PodUP
- To prevent or investigate possible wrongdoing in connection with the Services
- To protect the personal safety of users of the Services or the public
- To protect against legal liability
The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
Our Policy on “Do Not Track” Signals under the California Online Protection Act (CalOPPA)
We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.
You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
Third-Party Integrations
You may connect third-party integrations to your PodUP account, which may ask for certain permissions to access data or send information to or from your PodUP account. It is your responsibility to review any third-party integrations you authorize. We may collect information about what types of integrations you use in your PodUP account.
Any permission(s) granted by you, grants these third-parties access to your data, which may include (but is not limited to) granting third-party applications access to view, store, and modify your PodUP account data. We are not responsible for the practices of third-party applications.
Google/Gmail Integration
Google Analytics is a web analytics Services offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Services. This data is shared with other Google Services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
You can opt-out of having made your activity on the Services available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

If you use the Gmail integration or choose to integrate any other Google Workspace application with PodUP, you may be asked to give us access to information from your Gmail or Google account. You can learn more about how we access this data via in-app notice when you connect to Gmail.
By using the Gmail integration with the Subscription Services you will grant the Subscription Services access to information associated with your account, including contacts, emails, calendar, distribution lists, subject lines, and URLs of tracked links from your email, if you use the email tracking functionality. In addition, the Subscription Services will be able to read, modify, create, and send emails from your connected Gmail account. The Subscription Services will scan the content of your emails to identify which emails you have elected to track in order to provide you with the notifications feature. The Subscription Service will store replies, outgoing mail, email headers, subject line, distribution lists, aliases, time sent, and email bodies. Your email may contain sensitive information, such as names of your contacts, your private communications, or financial or medical information. You understand that the correspondences you track will be visible to PodUP as well as other users on your Subscription Services team.
Remarketing Services.
PodUP may use remarketing services to advertise on third-party websites to you after you visited our Services. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Services.
Google Ads
Google Ads (AdWords) remarketing service is provided by Google Inc. You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page.
Google also recommends installing the Google Analytics Opt-out Browser Add-on for your web browser. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics. Sale of Personal Information of Minors Under 16 Years of Age
We do not knowingly collect personal information from minors under the age of 16 through our Services, although certain third-party websites that we link to may do so. These third-party websites have their own terms of use and privacy policies and we encourage parents and legal guardians to monitor their children's internet usage and instruct their children to never provide information on other websites without their permission.
We do not sell the personal information of we actually know are less than 16 years of age, unless We receive affirmative authorization (the “right to opt-in”) from either the User who is between 13 and 16 years of age, or the parent or guardian of a User less than 13 years of age. Users who opt-in to the sale of personal information may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request by contacting us.
If you have reason to believe that a child under the age of 13 (or 16) has provided us with personal information, please contact us with sufficient detail to enable us to delete that information.

The CCPA provides California residents with specific rights regarding their personal information. If you are a resident of California, you have the following rights:

- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
- The right not to be discriminated against. You have the right not to be discriminated against for exercising any of your consumer's rights, including by:
- Denying goods or services to you
- Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties
- Providing a different level or quality of goods or services to you
- Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services
Exercising Your CCPA Data Protection Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your personal information.
Your request to us must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it
We cannot respond to your request or provide you with the required information if we cannot:
- Verify your identity or authority to make the request; and
- Confirm that the personal information relates to you
We will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.
Any disclosures we provide will only cover the 12-month period preceding the verifiable request's receipt.
For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.
Do Not Sell My Personal Information
You have the right to opt-out of the sale of your personal information. Once we receive and confirm a verifiable consumer request from you, we will stop selling your personal information. To exercise your right to opt-out, please contact us.

PodUP and its affiliates may collect, use and disclose for business purposes your personal data. Depending on the specific PodUP service or product you use, PodUP and its affiliates may use your Personal Data for various business purposes, including any and all of the Personal Data purposes or categories stated in this Privacy Policy, including, but not limited to: (1) to provide, manage, support and improve our products and services; (2) to maintain and service your account; (3) to verify you, your account activity and your information; (4) to detect, investigate and report fraud, abuse or illegal use of our products and services or customer accounts; (5) to provide customer service; (6) to provide advertising and marketing to our customers; and (7) to measure our marketing campaigns and to audit consumer interactions.
Children
Our Services do not address anyone under the age of 18 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 18. PodUP use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.
YouTube: You can connect your YouTube channel to PodUP via YouTube API Services. Make sure you are aware of YouTube Terms of Service and Google Privacy Policy. On disconnecting YouTube channel from PodUP, PodUP will remove the stored data associated with that YouTube channel. In addition, you can revoke YouTube API Services access & permissions from Google Security Settings page.
Updates
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
We will attempt to let you know via email and/or a prominent notice on our Services, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy. Any use of the Services following the effective date shall be conclusive evidence of your acceptance of said updated Privacy Policy.
